Charles the Constitutional Scholar on the 14th Amendment

May 28, 2010

This is nothing short of amazing:

So according to the brilliant constitutional scholar (did he study under the brilliant Professor Obama?), the entirety of the Fourteenth Amendment can be summed up by citizenship for anyone born on American soil.

Funny, I always thought there was something else in there about all citizens having equal rights or something like that. Crap, what was I thinking?

And I’ve lost count, but this has got to easily be the twentieth Ran Paul thread since his nomination.  Obsession, anyone?

on a day when the president of the united states sinks closer and closer to impeachment in the sestak affair, this piece of shit icarus chooses to ignore this real news

and by the way, rand paul is right and probably 80% of americans agree with not granting citizenship to every kid born to an illegal

this is espacially important in Michigan where every pregnant syrian , lebanese, yemeni woman they have flies over here bursting and gives birth. then they bring the whole fucking family over and all go on welfare!

    Go rand go !

Indeed, it’s not a fringe position to question whether that small portion of the 14th amendment was a mistake. And doing so hardly qualifies as “dumping” the entire amendment.

As Buzzsawmonkey has said on several occasions, the clause in the amendment was a clumsy attempt to make sure that freed slaves were full citizens. They people who wrote the amendment could have never imagined what this would become. The intent was never to allow foreign born parents to arrive illegally and give birth to legal citizens. This, in short, was a mistake.

And there would be no reason to allow legally resident aliens’ children to be citizens automatically. Certainly no constitutional mandate. Legally resident aliens come in all colors – in fact they are more ethnically and culturally diverse than illegal aliens, because the US does not discriminate on the basis of color in its quotas for admission of people to live and work here.
Why the Wally and others want to promote Mexico above all other national origins on the basis of geographical proximity is arbitrary and unjust.

I think the US is the only country in the world that has this weird law!

Macau had a ‘touch base’ citicizenship policy back when it was a Portugese colony, IIRC. You just simply had to show up to be eligible for citizenship.

We call them anchor babies. Happens all the time in Canada.

A lot of women will come here pregnant, have their babies who are automatically Canadian citizens, then after they’re here a couple of years (or however long it takes) and the adults have their citizenship, they go back to the home country. Their Canadian citizenship is a get-out-of-China or -Lebanon or -wherever-free-card. Some people think it’ll be easier for their kids to come here for university (if they decide that’s what they want). And they can come back here for free health care and old age security when they’re old and decrepit, after not having paid taxes or contributed to the system for the past 40 years.
